Terms of Service

These terms govern your use of Frankie, a WhatsApp-based AI assistant for families, operated by Carpe Diem Labs, Inc. ("we", "us", "our"). By using Frankie, you agree to these terms.

1. The service

Frankie is an AI assistant that helps parents manage school communications, family calendars, activity schedules, and daily logistics via WhatsApp. Frankie is a tool to help you stay organised — it is not a substitute for your own judgement as a parent.

2. Who can use Frankie

You must be at least 18 years old.
You must have a valid WhatsApp account.
You are responsible for all activity under your account.

3. Free trial and subscription

New accounts receive a 14-day free trial with full access.
After the trial, a paid subscription is required to continue using Frankie.
Subscriptions are billed monthly via Stripe. You can cancel at any time.
Cancellation takes effect at the end of the current billing period. No refunds for partial months.

4. What you can expect from us

We will make reasonable efforts to keep Frankie available and functioning.
We will protect your data as described in our Privacy Policy.
We will not sell your personal data or share it for advertising purposes.

5. What we expect from you

Use Frankie for its intended purpose: family organisation and communication.
Do not use Frankie to send spam, abuse, or illegal content.
Do not attempt to reverse engineer, exploit, or misuse the service.
Do not share confidential or sensitive information beyond what is needed for family scheduling (e.g. do not send financial documents, medical records, or legal documents).

6. AI limitations

Frankie uses AI to process messages and documents. While we work hard to make responses accurate and helpful:

AI can make mistakes. Always verify important dates, times, and details.
Translations are AI-generated and may not be perfect.
Calendar events created by Frankie should be reviewed for accuracy.
Frankie is not a legal, medical, or financial advisor.

7. Calendar integration

If you connect your Google Calendar:

Frankie can read, create, and modify events on calendars you grant access to.
You can disconnect your calendar at any time by saying "disconnect calendar" or revoking access in your Google Account settings.
We are not responsible for events incorrectly created or modified. Always review calendar changes.

8. Co-parenting features

Frankie can be used by both parents in a family. Each parent has their own account and can manage shared schedules. If you choose to separate from a shared family group, your individual data will be preserved and your co-parent's access is unaffected.

9. Data deletion

You can delete all your data at any time by sending "delete my data" to Frankie. This permanently removes your profile, documents, schedules, and routines. This action cannot be undone.

10. Limitation of liability

Frankie is provided "as is" without warranty of any kind. To the maximum extent permitted by law, Carpe Diem Labs, Inc. shall not be liable for any indirect, incidental, or consequential damages arising from your use of the service, including but not limited to missed events, incorrect translations, or scheduling errors.

11. Changes to these terms

We may update these terms from time to time. If we make material changes, we will notify you via WhatsApp. Continued use of Frankie after changes constitutes acceptance of the updated terms.

12. Governing law

These terms are governed by the laws of Austria. Any disputes shall be resolved in the courts of Vienna, Austria.
